Multi part real estate question.Help?


Well, I’ve gotten myself into a bit of a jam, and I need some advice. Long story short, I’ve signed a contract to purchase a rehabbed home with 2 investors. Well, the home was supposed to be complete in Feb. at the latest. It is now almost May. I’ve been staying in short term housing for the past few months waiting for them to finish. Now my problem..One of the investors is dragging his feet and has not done his part in this project, while the other is working hard. We moved all of my belongings into the house in Jan. because I was supposed to move in. We hit a snag with the city about some pending work orders and I could not move in. I was told it would take a month to complete…the next month I heard the same thing. So, I have decided to purchase the home as is. Our orignial contract says that I would buy the home for 80% of the appraisal price once it’s completed. Now, I still have some work to do on the home and I’m not sure he is going to offer what I want to pay. My question is
if he doesn’t then could I go into the house to get my stuff out or would that be trespassing since it’s in his name. He has changed the lockbox code on the house, so I cannot get in at the moment. Also, he has lost the keys to the lock on the door. If I cut the lock off to move my stuff out, am I trespassing?
Oops, just noticed that part about the lock!! The keys that he lost go to an lock on the door that is my belongings are stored in. Not the front door…Sorry!

    If you cut the lock you are breaking and entering.

    There is a key in the lock box.

    You need to arrange a time to meet with him to remove your belongings. But, no, you can not break in and take them.
